Guard Checker — SIA Workforce Compliance Platform

These Terms of Use (“Terms”) govern your access to and use of the Guard Checker platform and website at www.guardchecker.co.uk, operated by Guard Checker Ltd (“Guard Checker”, “we”, “us”, or “our”).
By registering for an account, starting a free trial, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
These Terms constitute a legally binding agreement between you (and the organisation you represent) and Guard Checker Ltd.
You must be at least 18 years of age and have the legal authority to enter into contracts on behalf of your organisation in order to use the Service.
You agree to provide accurate, current, and complete information during registration and to keep your account details up to date. Guard Checker is not liable for issues arising from inaccurate account information.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@guardchecker.co.uk if you suspect unauthorised access.

Licence data displayed in the Service is sourced from the official SIA public register. While we strive to provide accurate, up-to-date results, Guard Checker does not operate, own, or control the SIA register. We cannot guarantee that data retrieved from the SIA register is error-free or complete. You should independently verify any critical compliance decisions.
Guard Checker offers a 7-day free trial on all plans. No credit card is required to begin a trial. At the end of the trial period, continued access requires a paid subscription. We reserve the right to modify or discontinue the trial offer at any time.
Guard Checker offers a range of subscription tiers to suit different workforce sizes, billed monthly. Current pricing for each plan is displayed on our website at www.guardchecker.co.uk. Pricing is subject to change. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.
Subscriptions are billed monthly in advance. Payment is processed by our third-party payment provider. You authorise us to charge your payment method on a recurring basis until you cancel.
There are no minimum contract terms. Subscriptions run on a rolling monthly basis and may be cancelled at any time.
Subscription fees are non-refundable except where required by applicable law. If you cancel mid-month, you will retain access until the end of the current billing period.
If your active operative count exceeds the limit for your plan, we will notify you and request that you upgrade. We reserve the right to restrict access to features or limit additional operatives until your plan is upgraded.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

You retain ownership of the workforce data you input into the Service (operative names, licence numbers, and related information). By using the Service, you grant Guard Checker a limited licence to process that data solely for the purpose of delivering the Service.
You are the data controller for the personal data of your operatives that you submit to the Service. You are responsible for:
Where Guard Checker processes your operatives' personal data on your behalf, we act as a data processor. Our Privacy Policy and any applicable Data Processing Agreement govern this processing.
SIA licence holder data is publicly available under section 12 of the Private Security Industry Act 2001. Guard Checker retrieves this data on your behalf as an authorised user of the public register.
All intellectual property rights in the Guard Checker platform, including its software, design, databases, trademarks, and content, are owned by or licensed to Guard Checker Ltd. Nothing in these Terms transfers any IP rights to you.
You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.
Guard Checker targets 99.9% platform uptime. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime caused by third-party infrastructure providers, the SIA register being unavailable, internet disruptions, or events outside our reasonable control.
In the event of extended unplanned downtime, we will endeavour to provide updates via the website or by email.
Guard Checker is a tool to assist with SIA licence monitoring. It does not constitute legal advice or guarantee regulatory compliance. You remain solely responsible for your organisation's compliance with the Private Security Industry Act 2001 and any associated regulations.
To the fullest extent permitted by applicable law, Guard Checker's total aggregate liability to you arising out of or in connection with these Terms or the Service shall not exceed the total fees paid by you in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits our liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
You agree to indemnify and hold harmless Guard Checker Ltd and its officers, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your use of the Service in breach of these Terms, your violation of any law, or your infringement of any third-party rights.
You may cancel your subscription at any time through your account settings or by contacting us at support@guardchecker.co.uk. Cancellation takes effect at the end of the current billing period.
We reserve the right to suspend or terminate your access to the Service immediately if:
We may also terminate or discontinue the Service on 30 days' written notice for any reason.
On termination, your right to use the Service ceases immediately. You may request an export of your workforce data within 30 days of termination. After that period, we may delete your account data in accordance with our Privacy Policy.
We may update these Terms from time to time. We will provide at least 14 days' notice of material changes by email or via the platform. Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
We may also modify, update, or discontinue features of the Service at any time, subject to reasonable notice where changes materially affect core functionality.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before initiating formal proceedings, both parties agree to attempt to resolve disputes in good faith through direct discussion for a period of 30 days.
